Governing Provisions

Purchasing of products on this website is subject to all applicable laws and regulations and to these Terms and Conditions. You accept, without limitation or qualification, these Terms and Conditions, which form a legally binding agreement between you and, Dancing Boutique when the first of the following occurs: (a) you order goods through this website; (b) you pay for the ordered goods; (c) you have received delivery of the whole or any part of the ordered goods; or (d) you have otherwise assented to these Terms and Conditions.

These Terms and Conditions may be changed by us from time to time without specific notice to you. The latest Terms and Conditions will be posted on the website, and you should always review these Terms and Conditions prior to using the website to ensure that you have a current understanding of the Terms and Conditions under which you are permitted to access this website. If you cannot access the Terms and Conditions via the Internet, we can provide a copy of the most recent Terms and Conditions by e-mail upon request. Please e-mail us at sales@dancingboutique.com.

Entire Agreement

These Terms and Conditions contain the entire understanding between you and us with respect to use of this website and no representation, statement, inducement oral or written, not contained herein shall bind any party to this agreement. No additional or different terms or conditions will be binding upon us unless specifically agreed to in writing by an officer of Dancing Boutique. No other representative has any authority to waive, alter, vary or add to the terms hereof. Before using this website please read through these terms carefully.

Ordering

By placing an order, you are confirming that all contact details provided are accurate and you have permission to provide them. Payment will be taken when the order is placed, and the order will be completed as per your selected shipping method. You will receive an email confirming your order. It is your responsibility to check all details are correct, including ordered items and address details. Should you need to amend your order, please contact our sales team on 01892 523399.

Payments

You can place an order using a debit/credit card, by creating a secure account or checking out as a guest.

Purchases will be made in Pounds Sterling. International credit card providers or banks will determine the exchange rate and may add an additional processing or administration charge in relation to such payment which international credit card holders will be liable to pay.

Availability

Dancing Boutique works hard to keep the website and stock levels up to date. If an item is temporarily out of stock, we will notify you of such and do our utmost to fulfil your order as quickly as possible. In this case we will place an order with our supplier and ship it to you as soon as possible, with no additional shipping charges. The available items in your order will be shipped to you as normal.

Dancing Boutique reserves the right to reject or cancel any orders, in the event of:

  • Product out of stock / discontinued
  • Incorrect address / outside of UK delivery request
  • Incorrect billing information
  • Fraudulent activity
  • Pricing and descriptions error on the website outside of our control
  • Force majeure

Pricing

All our prices are quoted including VAT, where applicable. In the event of any price changes from our suppliers we reserve the right to adjust any prices accordingly with immediate effect.

Accuracy of content

Dancing Boutique has taken every care in the preparation of the content of this website, to ensure that prices quoted are correct at time of publishing and all products have been fairly described using supplier information. However, colours can vary when seen on a screen, images can be for illustrative purposes, packaging may alter at times and supplier wording may change. If you need help with an item, please call or email us.

Delivery

All orders are double checked prior to dispatch, however, if any picking errors do occur then notification must be within 48 hours from receipt of the goods.

International Delivery

Dancing Boutique products are sold on a Delivery Duty unpaid basis. The recipient may have to pay import duty or a formal customs entry fee prior to or on delivery. Additional taxes, fees or levies may apply according to local legislation.

For these reasons, our products are currently only available within the UK.

Cancellation Rights

Under Consumer Contract Regulations, you may cancel an order within 14 days of purchase. You must put your cancellation request in writing or by email to sales@dancingboutique.com . If goods have already been dispatched, they must be returned to us. On receipt and where all items are eligible to be returned (see below) the cost of you order will be refunded including our standard delivery charge. However, you will be responsible for paying the cost of returning the items to us.

Returning Goods

You may return eligible items for a refund of the goods within 28 days of receipt of the products. Please check your items are eligible for return and follow the returns process set out below. The cost of returning unwanted items is to be paid for by you.

For faulty or incorrect items shipped the returns costs will be paid for by us.

What Items Can You Return?

Eligible items:

Unwanted goods in an unworn state, with labels attached, free from make-up, pet hair, odour and deodorant marks and in the original packaging.

Accessories in their original packaging.

Not eligible for return:

Items that do not meet the conditions of the items as stated above.

For hygiene reasons, we are unable to accept tights and underwear

Custom made to order items

Faulty items:

All genuinely faulty items are eligible for return including custom made orders, underwear, tights, pointe shoes or items otherwise ineligible.

If once inspected, on return to Dancing Boutique, the item is deemed to have been damaged through being worn, the item will be considered outside of our faulty item returns policy.

How to return items:

Please complete the Returns Form included with your order and enclose this with the items to be returned. If you need to talk to us and check the eligibility for your return, call us on 01892 529720.

We recommend using a signed for or tracked service as we accept no responsibility for mislaid or lost parcels.

How long to process a return?

Your return and refund will be received and processed as quickly as we can but can take up to 14 days. Once the refund is processed and accepted, the amount will be credited back to the original payment method.

Items that are deemed ineligible for return or received outside the 28 day returns window will not be refunded. In such cases we will advise you by email. You then have the option to pay an additional postage charge to return the items to you, to collect them from our store (items will be held for 14 days) or we can dispose of them on your behalf.

This does not affect your statutory rights.

Exchanging items:

If you require another size/colour, please return the item to us for a refund and re-order the correct item on our website.

We are unable to process requests for exchanges. However, if your item is faulty or has been sent by us incorrectly, once we receive the item back, we will be able to arrange a replacement to be sent out to you free of charge, as per our returns policy.

Limitation of Liability

In no event shall Dancing Boutique be liable for any indirect, incidental or consequential damages of any kind, whether for breach of any warranty or otherwise.

In no event shall our aggregate liability to you arising under or in any way related to your purchase order, the transaction to be entered into pursuant to it or these Terms and Conditions exceed the total amount paid by you for the products purchased.

We shall have no liability to you for any delay in the delivery of products ordered or any other matters to the extent that the delay is due to any event outside our reasonable control, including but not limited to acts war, flood, fire, labour disputes, strikes, lock-outs, riots, civil commotion, malicious damage, explosion, governmental actions and any other similar events.

Any disclaimers and exclusions of liability in these terms & conditions shall not apply to any damages arising from death or personal injury caused by the negligence of Dancing Boutique or any of its employees or agents or fraud. These disclaimers and exclusions shall be governed by and construed in accordance with English Law. If any provisions of these disclaimers and exclusions shall be unlawful, void or for any reason unenforceable then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
